Just need your thoughts. We are currently in a long correspondence trail with a resident where some traffic calming is being proposed. As part of the notice period we consulted key stakeholders, put notices on site and in the local newspaper. The resident is trying to claim that we didn't consult with him directly and he should have had individual notices. RHR 1999 states that C. we consult with those affected. Would you in other LA's consider, or do, send individual notices/letters to residents affected??:

(c)in all cases, organisations appearing to him or them to represent persons who use the highway to which the proposal related, or to represent persons who are otherwise likely to be affected by the road hump.

Hi Andrew,

Since covid, we (West Sussex County Council) have sent letters to all of those directly affected. We haven't yet gone back to the pre-Covid methods. Any Traffic Regulation Order or Traffic Calming measure falls under this. Although I don't think it's necessary, it's just our working procedure.

Thanks

Hello Andrew,

I have worked with many LA's and consultation varies throughout. My advice is where a restriction or new infrastructure is being introduced, I would undertake a letter drop to the affected frontages as an informal consultation prior to any mandatory consultation. I feel, this gets the frontages involved by making them aware, and hopefully address any concerns raised before mandatory consultation. BTW a road hump notice doesn't invite objections, unlike a TRO notice.

I hope this helps

Cheers

Chris

Thanks everyone for response. I'm actually BCP Council not Dorset as shown. Profile doesn't seem to have caught up.

Some good thoughts to ponder on our procedures on traffic calming notice, but yes good point Chris, I think we already carried out scheme consultation prior to tghe 'legal' notice so it may have been covered that way by our LTP Improvements Team. Thanks
